Rental Agreement
This agreement is between Fox Box Rentals LLC, an Illinois limited liability company ("Fox Box," "we," "us"), and the person or business named in the booking ("Customer," "you"). By checking the agreement box at booking or at checkout, you accept these terms.
1. Equipment
We rent you the number of reusable plastic totes, lids, dollies, zip ties and labels shown in your booking (the "Equipment"). The Equipment belongs to Fox Box at all times.
2. Rental period
The rental starts on the delivery date and runs for the period in your booking, normally 14 days. You may extend by contacting us before the scheduled pickup. Extensions are billed at the weekly rate for your package, for each week or part of a week.
3. Fees and payment
You pay the package price, any add-ons, any delivery fee outside our free zone, and applicable taxes at booking. You also agree to these fees when they apply:
| Fee | Amount |
|---|---|
| Extra week, Kit / Den / Pack | $20 / $30 / $40 |
| Missed pickup (Equipment not empty or not accessible) | $35 per return trip |
| Cancellation within 24 hours of delivery | $30 |
| Lost or damaged tote (bin and lid) | $20 each |
| Lost or damaged dolly | $40 each |
4. Taxes
Illinois treats equipment rentals as retail sales. We collect state and local sales tax on rental charges as required.
5. Delivery and pickup
We deliver and pick up within the window we confirm with you. Someone age 18 or older should be present at delivery, or you may tell us a safe place to leave the Equipment. At pickup, all Equipment must be empty, stacked and accessible at the address in your booking. If you leave Equipment unattended for pickup, you accept our count and photos as the record.
6. Your responsibilities
Use the Equipment only for packing, moving and storing ordinary household or business goods. Do not overload a tote or dolly, stack totes more than 5 high, or leave Equipment where it could be stolen or damaged by weather.
7. Prohibited contents
No hazardous, flammable or explosive materials, chemicals, perishable food, live animals, unsealed liquids, firearms or ammunition, or anything illegal.
8. Your contents are your responsibility
We never take custody of your belongings. We do not inspect, insure or accept responsibility for anything you pack in, stack or move with the Equipment, including breakage, water damage, theft or loss. Consider your homeowner's, renter's or mover's insurance for your contents.
9. Inspection and damage reports
Report any missing or damaged Equipment within 48 hours of delivery, or it is considered delivered complete and in good condition. Normal wear such as scuffs and minor scratches is not damage.
10. Lost and damaged Equipment
You are responsible for Equipment from delivery until we pick it up. We charge the fees in Section 3 for Equipment that is missing or damaged beyond normal wear. Equipment not returned within 30 days after the scheduled pickup date is treated as lost.
11. Payment authorization
You authorize us to save the payment card used at checkout and charge it for extra weeks, missed pickups, late cancellations, and lost or damaged Equipment under this agreement. We email you an itemized receipt with photos before or when we make any such charge. You may dispute a charge by emailing us within 14 days.
12. Cancellation
You may cancel for a full refund more than 24 hours before delivery. Cancellations within 24 hours carry the fee in Section 3. If we must cancel, we refund you in full.
13. Assumption of risk
Lifting, carrying and stacking loaded totes involves a risk of injury. You use the Equipment at your own risk and are responsible for anyone who uses it on your behalf.
14. Limitation of liability
To the fullest extent Illinois law allows, our total liability under this agreement is limited to the amount you paid for the rental. We are not liable for indirect, incidental or consequential damages, including delays in your move.
15. Indemnity
You agree to indemnify and hold Fox Box harmless from claims arising from your use of the Equipment, your contents, or your breach of this agreement, except to the extent caused by our negligence.
16. Disputes and governing law
Illinois law governs this agreement. Any dispute will be handled in the courts of Kane County, Illinois, including small claims court.
17. Electronic acceptance
Checking the agreement box online is your electronic signature. We keep a record of your acceptance with the date and time.
18. Entire agreement
This agreement, your booking and any signed addendum are the whole agreement between us. If any part is unenforceable, the rest stays in effect.
